Terms of Use and Services

1.1 In this document, the following expressions have the meanings set forth below:

a) USERS: Anyone who accesses the PLATFORM.

b) VISITOR: An individual without an account on the PLATFORM, who accesses the advertising content offered by ADVERTISERS on the PLATFORM and must confirm their age to access sensitive content.

c) CONTRATANTE/CLIENTE: Pessoa física cadastrada na PLATAFORMA, que acesse os conteúdos publicitários ofertados pelos ANUNCIANTES na PLATAFORMA, podendo contratar videochamadas, adquirir pacotes de tokens, participar de lives e enviar gorjetas.

d) ANUNCIANTE: Pessoa física cadastrada na PLATAFORMA, que, no uso desta, irá divulgar o seu anúncio aos VISITANTES e CONTRATANTES, podendo também realizar transmissões ao vivo (lives) e videochamadas pagas.

e) SUBSCRIBER: An individual registered on the PLATFORM as an ADVERTISER, who hires PLATFORM services to optimize the visibility of their ad through benefit plans.

f) PLATAFORMA: Sistema constituído por uma aplicação web acessível em privelt.com, onde há cessão de espaço publicitário para anúncios, sistema de videochamadas, transmissões ao vivo e demais funcionalidades.

2.1 Este instrumento trata-se de um contrato particular que regula as condições de uso dos serviços da PLATAFORMA entre os USUÁRIOS e a PRIVELT, sendo regido pela legislação Civil (Código Civil e Código de Processo Civil). A utilização dos serviços oferecidos através da PLATAFORMA indica expressamente que você concorda com todos os termos e condições contidos neste instrumento e com as disposições legais aplicáveis à espécie.

2.2 You understand and agree that PRIVELT will consider the use of the services offered as acceptance of these terms and all other applicable legal provisions.

2.3 Ao aceitar os termos do presente instrumento, o usuário autoriza expressamente o tratamento de seus dados, a fim de garantir a manutenção e o bom desempenho das funcionalidades na forma da Política de Privacidade da Plataforma.

2.4 Caso você NÃO CONCORDE com as disposições previstas neste instrumento, é sua obrigação NÃO acessar, visualizar, baixar ou utilizar de qualquer forma nenhuma página, conteúdo, informação ou serviço da PRIVELT.

2.5 These terms are available for reading at any time on the PLATFORM, at https://privelt.com/termos-de-uso.

3.1 A PRIVELT é uma plataforma que cede espaço publicitário e oferece infraestrutura tecnológica para comunicação entre USUÁRIOS, sendo sua responsabilidade restrita ao funcionamento correto da plataforma e de suas funcionalidades. A PRIVELT não é responsável por: (i) negociações entre usuários; (ii) opções de serviços prestados por pessoas anunciantes; (iii) qualidade dos anúncios; (iv) pagamentos acordados entre usuários fora da plataforma; (v) danos causados por terceiros, como ataques hackers; e (vi) atos ou fatos decorrentes da conduta dos usuários.

3.2 A PRIVELT permite contato direto entre visitantes e anunciantes, sem intermediar ou participar das negociações ou execução dos serviços anunciados. O ANUNCIANTE pode divulgar seu WhatsApp para agendamento direto de sessões em seu local de atendimento.

3.3 A plataforma apenas disponibiliza o espaço para anúncios e infraestrutura tecnológica (chat, videochamada, live) e não assume responsabilidade por danos causados por USUÁRIOS ou terceiros. Negociações e condições dos negócios realizados são de exclusiva responsabilidade dos USUÁRIOS envolvidos.

3.4 PRIVELT will not be held liable for damages arising from temporary platform unavailability, especially when beyond its control.

4.1 To register as an ADVERTISER, you must be 18 (eighteen) years old or older, have full legal capacity and provide truthful data.

4.2 É de exclusiva responsabilidade dos USUÁRIOS fornecer, atualizar e garantir a veracidade dos dados cadastrais, não recaindo à PRIVELT qualquer tipo de responsabilidade civil e criminal resultante de dados inverídicos, incorretos ou incompletos.

4.3 The ad is unique, personal and internally identified, and may not be used by third parties, shared, assigned or commercialized in any way.

4.4 Creating and/or using more than one account per USER on the PLATFORM is expressly prohibited.

4.5 A PRIVELT se reserva o direito de, unilateralmente, sem prévio aviso, recusar qualquer solicitação de cadastro ou suspender cadastros já ativos, temporária ou definitivamente, em caso de irregularidades.

4.6 The publication, disclosure or sharing of any content involving, referring to or related to minors is strictly prohibited.

4.7 Posted images generated or significantly altered by AI must be properly identified and are subject to moderation.

5.1 PRIVELT offers highlight plans for ads, lasting 7 (seven) days each:

— Plano Bronze: R$ 25,00 por 7 dias — 3 subidas ao topo por dia.

— Plano Prata: R$ 35,00 por 7 dias — 6 subidas ao topo por dia.

— Plano Ouro: R$ 55,00 por 7 dias — 12 subidas ao topo por dia.

5.2 Service delivery begins immediately upon payment confirmation.

5.3 Prices may change at any time, with 30 days' prior notice.

5.4 Purchasing highlight plans is entirely optional.

6.1 The ADVERTISER may set up video call packages with price and duration, offered to CUSTOMERS within the PLATFORM.

6.2 The revenue split for video calls is 70% (seventy percent) to the ADVERTISER and 30% (thirty percent) to the PLATFORM.

6.3 The video call has an automatic timer according to the package duration and ends automatically when finished.

7.1 The ADVERTISER may run live broadcasts (lives) on the platform.

7.2 During lives, CUSTOMERS may send tips using tokens purchased on the platform.

7.3 The revenue split for tips on lives is 70% (seventy percent) to the ADVERTISER and 30% (thirty percent) to the PLATFORM.

7.4 The ADVERTISER may set token goals with description and objective, visible to viewers.

8.1 A PLATAFORMA poderá monitorar, de forma automatizada ou manual, todas as interações realizadas na PLATAFORMA, incluindo, mas não se limitando a: perfis, fotos, vídeos, mensagens de chat, sessões de videochamada e transmissões ao vivo.

8.2 O monitoramento tem como finalidades exclusivas:

(i) ensure the safety of USERS;

(ii) prevenir fraudes e atividades ilegais;

(iii) assegurar o cumprimento destes Termos de Uso;

(iv) maintain service quality;

(v) comply with legal and regulatory obligations.

8.3 As sessões de videochamada e transmissões ao vivo poderão ser acessadas pela equipe de moderação da PLATAFORMA a qualquer momento, para os fins descritos no item 8.2. O ANUNCIANTE, ao aceitar estes Termos, manifesta ciência e consentimento expresso com esta prática de monitoramento.

8.4 The content of messages exchanged on the platform may be accessed by the moderation team in case of reports, violation investigations or compliance with court or police orders.

8.5 The PLATFORM may remove content and suspend or terminate accounts that violate these Terms, at its sole discretion, without prior notice and without refund.

8.6 O tratamento de dados decorrente do monitoramento descrito nesta seção encontra base legal na execução do contrato (Art. 7º, V da LGPD), no legítimo interesse do controlador para garantia da segurança da plataforma (Art. 7º, IX da LGPD) e na prevenção à fraude (Art. 7º, VI da LGPD).

8.7 The PLATFORM reserves the right to develop internal security and fraud-prevention features that will not be made available to USERS.

9.1 The following is expressly prohibited:

(i) publish content involving minors;

(ii) share content that promotes violence, coercion, exploitation or any illegal activity;

(iii) use third-party photos or videos without authorization;

(iv) harass, threaten or intimidate other users;

(v) share personal information of other users without consent;

(vi) create fake profiles or with false information;

(vii) use the platform for scams, extortion or any kind of fraud;

(viii) use AI to bypass platform security systems.

9.2 Non-compliance may result in temporary suspension or permanent banning, with no right to a refund.

10.1 All PLATFORM content (layout, code, brand, logo, institutional texts) is the exclusive property of PRIVELT.

10.2 Content posted by the ADVERTISER remains their property, with a non-exclusive license granted to the PLATFORM for display within the service.

10.3 The use of data scraping systems or automated collection of PLATFORM information is prohibited.

11.1 Payments are processed by third-party payment gateways, both domestic and international.

11.2 Accepted payment methods: PIX and international credit card, subject to availability.

11.3 PRIVELT is not responsible for interruptions in payment gateways.

11.4 In case of an undue or fraudulent chargeback, the PLATFORM reserves the right to immediately suspend the user's access.

12.1 Personal data processing is described in the Privacy Policy, which is an integral part of these Terms.

12.2 By registering, the ADVERTISER consents to the collection and processing of their data under the LGPD (Law No. 13,709/2018).

13.1 The penalties are: (i) suspension; (ii) blocking; and (iii) banning.

13.2 PRIVELT reserves the right to investigate and apply penalties at its sole discretion.

13.3 All ads not complying with the terms will be removed without refund and without prior notice.

14.1 PRIVELT may change these Terms at any time, publishing a revised version on the site.

14.2 Continued use after publication constitutes acceptance.

Any disputes shall be settled in the court of the District of Curitiba, State of Paraná, Brazil, with express waiver of any other, however privileged.
